TERMS & CONDITIONS

These Terms & Conditions ("Terms") govern your access to and use of the F&B Connect UAE website, platform, talent database, recruitment services and related services (collectively, the "Platform").
By accessing, registering with or using the Platform, you confirm that you have read, understood and agree to these Terms.
If you do not agree to these Terms, you must not use the Platform.
F&B Connect may update these Terms from time to time. The updated version will be published on the Platform with a revised "Last Updated" date. Continued use of the Platform following an update constitutes acceptance of the revised Terms, subject to applicable law.
1. ABOUT F&B CONNECT
F&B Connect is a hospitality-focused talent platform designed to connect food and beverage professionals with employers and recruitment opportunities in the United Arab Emirates.
The Platform provides services for two main types of users:
Job Seekers
Job seekers may:
Create a professional profile;
Submit their professional information and CV;
Identify preferred roles;
Provide information regarding their experience, location and availability;
Become part of the F&B Connect talent database;
Be discovered by authorised employers;
Receive contact from employers regarding relevant employment opportunities.
Employers and Hiring Companies
Employers may:
Search the F&B Connect talent database;
Use available search filters to identify potentially suitable candidates;
View candidate profiles;
View or download candidate CVs;
Contact candidates through the Platform by email;
Use candidate information for legitimate recruitment purposes.
F&B Connect is a technology and talent platform that facilitates connections between job seekers and employers.
Unless expressly agreed otherwise in writing, F&B Connect is not the employer of any candidate listed on the Platform and does not guarantee employment, interviews, job offers or successful recruitment outcomes.
2. ELIGIBILITY
By using the Platform, you confirm that:
The information you provide is accurate and not knowingly misleading;
You have the legal capacity to enter into these Terms;
You will use the Platform only for lawful purposes;
You will comply with all applicable laws and regulations;
You will not impersonate another person, company or organisation;
You will not create an account using false or misleading information.
F&B Connect reserves the right to refuse registration, suspend an account or terminate access where it reasonably believes that these Terms have been breached.
3. JOB SEEKER REGISTRATION
Creating a job seeker profile and being part of the F&B Connect talent database is free.
Job seekers are responsible for ensuring that all information provided in their profile and CV is accurate, current and complete.
Job seekers should update their profile when there are material changes.
F&B Connect does not guarantee that a job seeker will receive contact from an employer, be invited to an interview or obtain employment.
4. PROFILE VERIFICATION
F&B Connect may use a live LinkedIn profile or other professional information to assist with the verification of job seeker profiles.
Where required, job seekers may be asked to provide the URL of their LinkedIn profile.
Verification is intended to improve the quality and credibility of the talent database.
However, verification does not constitute a guarantee that:
All information provided by a job seeker is accurate;
Employment history is complete;
Qualifications are genuine;
The candidate is suitable for a particular position; or
The candidate will be suitable for employment.
F&B Connect may request additional information or decline to verify a profile where information cannot reasonably be validated.
F&B Connect reserves the right to remove or restrict profiles containing fraudulent, misleading or materially inaccurate information.
5. CANDIDATE TALENT DATABASE
By creating a profile and joining the F&B Connect talent database, a job seeker acknowledges and agrees that their professional profile may be made available to authorised employers using the Platform.
Information available to employers may include information such as:
Name;
Professional experience;
Current and previous positions;
Preferred roles;
Location;
Availability;
Qualifications;
Professional profile information;
CV;
Other information voluntarily provided by the job seeker.
The information visible to employers may depend on the information provided by the candidate and the functionality of the Platform.
Job seekers should not include passwords, banking information, government identification numbers or other highly sensitive information in their CV or profile unless specifically required for a legitimate purpose.
The collection, use, storage and processing of personal information is also governed by the F&B Connect Privacy Policy.
6. EMPLOYER ACCESS TO THE TALENT DATABASE
Employers with an active subscription may access the F&B Connect talent database in accordance with these Terms and the applicable subscription.
F&B Connect provides employers with:
Unlimited candidate searches;
Unlimited candidate profile views;
Unlimited candidate contacts through the Platform;
CV viewing;
CV downloading.
These services are not provided as a limited number of monthly credits.
There is therefore no monthly allocation of searches, profile views or candidate contacts that expires at the end of a billing period.
F&B Connect may, however, introduce reasonable technical, security or fair-use restrictions where necessary to protect the Platform, its users or its systems.
7. USE OF CANDIDATE INFORMATION BY EMPLOYERS
Employers may use candidate information obtained through F&B Connect only for legitimate recruitment and employment purposes.
Employers may:
Review candidate profiles;
Review candidate CVs;
Download candidate CVs;
Share candidate CVs internally with employees or authorised representatives who have a legitimate role in the relevant recruitment process;
Contact candidates regarding genuine employment opportunities.
Employers must not:
Sell candidate information;
Rent, license or commercially distribute candidate information;
Create or maintain a competing candidate database using F&B Connect data;
Use candidate information for unrelated marketing;
Add candidates to unrelated marketing databases;
Share candidate information with unauthorised external parties;
Use candidate information for purposes unrelated to recruitment;
Scrape, copy or systematically extract the F&B Connect database;
Use automated methods to circumvent Platform access controls;
Attempt to circumvent subscription or security restrictions.
Any internal sharing of candidate information should be limited to individuals who have a legitimate need to participate in the relevant recruitment process.
Employers remain responsible for ensuring that their use, storage and sharing of candidate information complies with applicable data protection and other applicable laws.
8. CV DOWNLOADS
Employers may download CVs made available through the Platform for legitimate recruitment purposes.
A downloaded CV may be stored by the employer for purposes reasonably connected with the relevant recruitment process.
Employers must take reasonable steps to protect downloaded CVs and other candidate information from unauthorised access, disclosure, copying or misuse.
Downloaded CVs must not be:
Sold;
Resold;
Published;
Distributed publicly;
Used for unrelated marketing;
Added to unrelated commercial databases;
Used for purposes unrelated to recruitment.
Where candidate information is no longer reasonably required for legitimate recruitment purposes, employers should securely delete or dispose of it in accordance with applicable data protection requirements.
9. CONTACTING CANDIDATES
Employers may contact candidates through the F&B Connect Platform using the contact functionality provided by F&B Connect.
The Platform's candidate contact functionality is email-based.
If a candidate voluntarily includes a telephone number in their CV or profile, that telephone number may be visible to an authorised employer where the relevant CV or profile is available to that employer.
F&B Connect does not control how a candidate-provided telephone number is used after it becomes visible to an authorised employer. Employers remain responsible for using such information lawfully and appropriately.
Employers must not use candidate contact information for spam, harassment, unsolicited commercial marketing or purposes unrelated to genuine recruitment.
10. EMPLOYER SUBSCRIPTIONS
Access to the F&B Connect talent database is available to employers through paid subscription plans or other paid services offered by F&B Connect.
The applicable subscription price, billing period and included features will be displayed before the employer completes the purchase.
Unless otherwise stated, the subscription provides:
Unlimited candidate searches;
Unlimited candidate profile views;
Unlimited candidate contacts through the Platform;
Access to candidate CVs;
Ability to download candidate CVs.
Subscription access is intended for the employer or organisation that purchased the subscription and may not be sold, transferred or shared with unrelated organisations.
11. MONTHLY AUTO-RENEWAL
F&B Connect employer subscriptions are monthly subscriptions and automatically renew each month unless cancelled.
By subscribing, the employer authorises F&B Connect or its payment provider to charge the applicable subscription fee at the beginning of each renewal period using the selected payment method.
The subscription will continue to renew until cancelled.
Employers may cancel their subscription at any time.
Unless otherwise stated at the time of purchase, cancellation will stop future renewals but will not terminate the already-paid subscription period.
12. CANCELLATION
Employers may cancel their subscription at any time through the applicable account or cancellation process provided by F&B Connect.
Cancellation will prevent the subscription from automatically renewing for the following billing period.
The employer will generally retain access to the paid services until the end of the current paid subscription period.
13. NO REFUNDS
Subscription fees are non-refundable, except where a refund is required by applicable law or expressly agreed by F&B Connect in writing.
Cancelling a subscription does not automatically create a right to a refund or partial refund for the current subscription period.
Because the F&B Connect subscription provides access to the talent database and its services during the subscription period, subscription fees are payable for the applicable billing period regardless of how frequently the employer uses the Platform.
14. PRICING AND PAYMENT
Subscription prices will be displayed on the Platform before purchase.
Applicable taxes, including VAT where applicable, may be added to the advertised price.
Employers are responsible for ensuring that payment information provided to F&B Connect or its payment provider is accurate and authorised.
If a payment fails, F&B Connect may restrict or suspend access to paid services until the outstanding payment has been successfully processed.
F&B Connect reserves the right to change subscription prices for future billing periods. Where required, reasonable notice will be provided.
15. EMPLOYER RESPONSIBILITIES
Employers are solely responsible for:
Evaluating candidates;
Conducting interviews;
Verifying qualifications and employment history where appropriate;
Conducting reference or background checks where appropriate;
Making hiring decisions;
Negotiating employment terms;
Complying with applicable employment laws;
Obtaining any required employment permits or approvals;
Entering into employment contracts;
Managing the employment relationship.
F&B Connect does not guarantee the suitability of any candidate.
16. NO GUARANTEE OF RECRUITMENT RESULTS
F&B Connect does not guarantee that:
An employer will find a suitable candidate;
A candidate will be available;
A candidate will respond to contact;
A candidate will attend an interview;
A candidate will accept an employment offer;
A candidate's information will remain current;
An employer will successfully fill a vacancy;
A job seeker will obtain employment.
F&B Connect provides a platform to facilitate connections between employers and job seekers.
The success of any recruitment process depends on the parties involved.
17. JOB SEEKER RESPONSIBILITIES
Job seekers must ensure that the information they provide to F&B Connect is accurate and not knowingly misleading.
Job seekers must not:
Create fraudulent profiles;
Misrepresent their qualifications or experience;
Impersonate another person;
Upload another person's CV without permission;
Provide false employment history;
Use the Platform for unlawful purposes;
Attempt to manipulate or abuse the Platform.
F&B Connect may remove or suspend profiles that violate these Terms.
18. PROHIBITED USE
Users must not use the Platform to:
Commit or facilitate unlawful activity;
Upload malicious software or harmful code;
Attempt unauthorised access to accounts or systems;
Interfere with the operation or security of the Platform;
Scrape or systematically extract Platform information;
Create fake job advertisements;
Create fraudulent candidate profiles;
Harass, threaten or abuse other users;
Engage in unlawful discrimination;
Send spam;
Circumvent subscription restrictions;
Create multiple accounts to evade restrictions;
Copy the Platform's database for commercial purposes;
Infringe the intellectual property or other rights of F&B Connect or another person.
19. PERSONAL DATA AND PRIVACY
F&B Connect collects and processes personal information in order to operate the Platform and provide its recruitment services.
The processing of personal information is governed by the F&B Connect Privacy Policy.
F&B Connect will process personal information in accordance with applicable data protection requirements.
The UAE Personal Data Protection Law, Federal Decree-Law No. 45 of 2021, establishes a federal framework governing the processing and protection of personal data and provides rights and obligations concerning personal information.
Job seekers acknowledge that their professional information and CV may be made available to authorised employers as part of the F&B Connect talent database.
Job seekers should carefully consider the information they include in their CV and profile.
20. DELETION OF A JOB SEEKER PROFILE
A job seeker may request the deletion of their F&B Connect profile.
When a job seeker deletes their profile, F&B Connect will remove the profile from the active talent database and delete or securely destroy the associated personal information, subject to information that F&B Connect is legally required or permitted to retain.
Once a profile has been removed from the active database, it will no longer be available to employers through the F&B Connect Platform.
F&B Connect cannot guarantee the deletion of copies of a CV that an employer has previously downloaded.
Employers are responsible for managing and deleting candidate information that they have downloaded in accordance with applicable law.
21. EMPLOYER DATA RESPONSIBILITIES
Employers acknowledge that candidate information accessed through F&B Connect may constitute personal data.
Employers are responsible for:
Using candidate information only for legitimate recruitment purposes;
Protecting candidate information from unauthorised access;
Restricting access to authorised personnel;
Not selling or commercially distributing candidate information;
Not using candidate information for unrelated marketing;
Complying with applicable data protection laws;
Securely disposing of candidate information when it is no longer required.
F&B Connect may suspend or terminate employer access where it reasonably believes candidate information is being misused.
22. INTELLECTUAL PROPERTY
All intellectual property rights relating to the F&B Connect brand, website, platform, design, software, database structure, logos, graphics, text and other content owned or licensed by F&B Connect remain the property of F&B Connect or its respective licensors.
Users may not copy, reproduce, modify, distribute, publish, sell, license or commercially exploit F&B Connect intellectual property without prior written permission.
Nothing in these Terms transfers ownership of F&B Connect intellectual property to a user.
23. USER-SUBMITTED CONTENT
By submitting a CV, profile information, photographs, professional information or other content to F&B Connect, you confirm that:
You have the right to provide that content;
The content is not knowingly false or misleading;
The content does not unlawfully infringe another person's rights;
The content complies with these Terms.
You grant F&B Connect the necessary permission to host, store, process and display the submitted information for the purpose of operating the Platform and providing its recruitment services, subject to the F&B Connect Privacy Policy.
24. THIRD-PARTY SERVICES
The Platform may contain links to third-party websites, services or professional profiles.
F&B Connect does not control and is not responsible for the content, availability, security or privacy practices of third-party websites or services.
Users access third-party websites and services at their own risk.
25. PLATFORM AVAILABILITY
F&B Connect aims to maintain a reliable Platform but does not guarantee that the Platform will always be available, uninterrupted or error-free.
The Platform may occasionally be unavailable because of:
Maintenance;
Updates;
Technical problems;
Hosting or service-provider issues;
Internet or telecommunications failures;
Cybersecurity incidents;
Events outside F&B Connect's reasonable control.
F&B Connect may modify, suspend or discontinue Platform features where reasonably necessary.
26. ACCOUNT SUSPENSION OR TERMINATION
F&B Connect may suspend or terminate an account where it reasonably believes that a user:
Has breached these Terms;
Has provided fraudulent information;
Has misused candidate information;
Has attempted to circumvent Platform restrictions;
Has engaged in unlawful conduct;
Has compromised Platform security;
Has used the Platform in a manner that may harm F&B Connect or its users.
F&B Connect may also remove content or restrict access to specific features.
Where an employer account is terminated due to a serious breach of these Terms, F&B Connect may terminate access to the talent database immediately.
Termination for breach does not automatically create a right to a refund.
27. DISCLAIMER
To the maximum extent permitted by applicable law, the Platform is provided on an "as available" basis.
F&B Connect does not guarantee the accuracy, completeness, reliability or suitability of information submitted by users.
F&B Connect does not guarantee the availability or suitability of any particular candidate or employment opportunity.
Employers are responsible for conducting their own recruitment due diligence before making hiring decisions.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
28. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, F&B Connect shall not be liable for indirect, incidental, special or consequential losses arising from the use of, or inability to use, the Platform.
F&B Connect is not responsible for disputes between employers and job seekers or for losses arising from employment relationships established following a connection made through the Platform.
F&B Connect is not responsible for:
Employment decisions;
Employment contracts;
Salaries;
Benefits;
Working conditions;
Visas or work permits;
Candidate performance;
Employer conduct;
Candidate conduct;
Termination of employment;
Disputes between employers and candidates.
Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.
29. INDEMNIFICATION
To the extent permitted by applicable law, users agree to indemnify and hold harmless F&B Connect, its owners, employees, representatives and service providers from claims, losses, liabilities and reasonable expenses arising from:
Their breach of these Terms;
Their unlawful use of the Platform;
Their misuse of candidate or employer information;
Their infringement of another person's rights;
Information or content they submit to the Platform;
Their recruitment activities or employment relationships.
30. COMMUNICATIONS
F&B Connect may send users communications necessary to operate their accounts and provide the Platform's services.
These may include:
Account notifications;
Security notifications;
Subscription notifications;
Payment notifications;
Platform updates;
Service-related communications.
Job seekers may receive employment-related contact from employers through the Platform based on the information and preferences provided in their profile.
Where marketing communications are sent, users will be provided with appropriate options to manage such communications where required by applicable law.
31. CHANGES TO THE PLATFORM
F&B Connect may introduce, modify or discontinue Platform features from time to time.
This may include changes to:
Search functionality;
Filters;
Profile functionality;
Employer tools;
Candidate tools;
Reporting;
Subscription features.
Where a material change affects an existing paid subscription, F&B Connect will provide appropriate notice where required.
32. CHANGES TO THESE TERMS
F&B Connect may amend these Terms from time to time.
The current version will be published on the Platform.
The "Last Updated" date at the top of these Terms will indicate when the Terms were most recently updated.
Where required by applicable law, F&B Connect will provide appropriate notice of material changes.
Continued use of the Platform after the updated Terms become effective constitutes acceptance of the revised Terms, subject to applicable law.
33. GOVERNING LAW
These Terms shall be governed by the applicable laws of the United Arab Emirates.
Any dispute arising from or relating to these Terms or the use of the Platform shall be subject to the jurisdiction of the competent courts of the United Arab Emirates, unless otherwise required by applicable law.
Where appropriate, the courts of the Emirate in which F&B Connect's relevant legal entity is registered shall have jurisdiction, subject to applicable law.
34. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable.
The remaining provisions shall continue in full force and effect.
35. ENTIRE AGREEMENT
These Terms, together with the F&B Connect Privacy Policy and any applicable subscription or service agreement, constitute the agreement between the user and F&B Connect concerning use of the Platform.
Where F&B Connect and an employer enter into a separate written agreement, the terms of that agreement will prevail to the extent of any conflict.
